RECOMMENDATION:  Adopt Project Stabilization Agreement (PSA) for Proposition S School Construction Repairs and Renovation.

BACKGROUND:
On January 13, 2009, the board adopted a resolution directing staff to negotiate the terms of a Project Stabilization Agreement (PSA) for Proposition S School Construction, Repairs, and Renovation.  Since the adoption of the resolution, district staff has sought and received input and information from parties interested in the PSA, in favor, opposed and neutral, and met and negotiated a PSA to carry out the board’s resolution.  Through this action the board will approve and adopt a Resolution and its Attachments as the Project Stabilization Agreement for Proposition S funded projects.  Upon adoption and the effective date, Contractors and Subcontractors of whatever tier utilized for covered work will be required to accept and be bound by the terms and conditions of the Project Stabilization Agreement, evidencing their acceptance by the execution of a Letter of Assent.
